Shiba License

Introduction:
The Shiba License is a license with the intention of allowing small creators, business and artists to permissionlessly use media while protecting the media from use by large entities.
This is a license agreement between the content creator (hereinafter referred to as the "Licensor") and any person or entity that wishes to use the media subject to the terms herein (hereinafter referred to as the "Licensee").
Grant of License:

Permission for Remixing and Unmodified Redistribution:

The Licensor grants the Licensee the right to remix and redistribute the media in an unmodified form, subject to the conditions laid out in this license.

Attribution Requirement:

The Licensee must provide attribution to the Licensor for the original media. The attribution should be clear and prominently displayed.

Commercial or Political Projects:

For any commercial or political projects, the Licensee must contact the Licensor before using the media. The terms of use for such projects must be explicitly agreed upon between the Licensor and the Licensee.

Use by Artists, Open Source Projects, and Small Content Creators:

Artists, open source projects, and small content creators (individuals making less than 2 times the median annual income for their country of residence from their content creation business) are granted permission to use the media without prior approval, as long as proper attribution is included in the finished product, including metadata such as YouTube descriptions.

Definition of Small Content Creators:

Small content creators are individuals who do not fall under the category of "artists" and make less than 2 times the median annual income for their country of residence from their content creation business. The small content creator’s revenue is assessed either by last calendar year’s revenue, or by the summation of revenue over the last 12 months, whichever is greater.

Definition of Artist:

For the purposes of this license agreement, an "artist" is defined as an individual who, in the creation of original works of art, demonstrates creativity, skill mastery, intentional expression, and produces works with aesthetic value. Artists engage in individual pursuits, showcasing proficiency in their chosen artistic medium and contributing to the cultural and creative landscape. The term "artist" in this agreement encompasses creators across various artistic disciplines, including but not limited to visual arts, performing arts, literature, and digital media

Commercial Projects:

Content creators who do not meet the criteria for small content creators are considered "Commercial Projects" and must follow the procedures outlined for commercial or political projects.

“””Artists””” who do not meet the criteria for artists are considered "Commercial Projects" and must follow the procedures outlined for commercial or political projects.

Protection of Licensee

Licensees who produce art or content derived from the licensed media, who attain rapid, transient or unexpected success from their works, are not retroactively responsible for seeking explicit approval and agreement of media use, like a Commercial or Political entity.
Conditions:

Non-Exclusivity:

This license is non-exclusive, and the Licensor retains the right to grant licenses to others.

No Warranty:

The media is provided "as-is," without any warranty. The Licensor shall not be liable for any damages arising from the use of the media.
Termination:

Breach of Terms:

The license is automatically terminated if the Licensee breaches any of its terms. Upon termination, the Licensee must cease using the media.
